Privacy policy

Introduction 

I recognise that my relationships with clients are built on mutual trust, transparency and confidence. Confidentiality will always be paramount. This Privacy Notice explains the types of personal data I may collect about you when you interact with me. It also explains how I’ll store and handle that data and keep it safe. It is intended to demonstrate my commitment to protecting and respecting your privacy and the security of the personal data I hold and process about you.  

In most circumstances your data will be held by me, Yvette Coldicott, as a “Data Controller”, which means that I am responsible for deciding how I hold and use your personal information. I am a sole trader. My postal address is Wood End, Main Road, Winchester, SO21 1AX

Legal bases for processing 

I will only use your personal data where I have a legal basis to do so and will always respect your rights (which are outlined later in this notice).  

Some examples of the legal bases I may use to process your personal data are as follows: 

  • Consent: in certain situations I can collect and process your data with your consent, for example when you register with me and tick a box to receive email updates from me.   

  • Contractual obligations: in certain circumstances, I need your personal data to comply with my contractual obligations to you, for example if you are a coaching client. 

  • Legal compliance: If the law requires me to, I may need to collect and process your data, for example in relation to law enforcement.  

  • Legitimate interest: In certain situations, I may can collect and process your data to pursue my legitimate interests in a way which might reasonably be expected as part of running my business and which does not materially impact your rights, freedoms or interests. For example, I may use information on LinkedIn or in the public domain to approach you about my services, and I may use your usage of my website to send you direct marketing information, telling you about products and services I think may interest you. I may also combine your usage of my service with that of many users to identify trends and learnings to improve the services. 

Why I use your personal data 

I use your data: 

  • To respond to your queries and feedback. Handling information you send me enables me to respond. I may also keep a record of these to inform future communication with you. I do this on the basis of my contractual obligations to you, my legal obligations and my legitimate interests in providing you with best service and understanding how I can improve my service based on your experience. 

  • To provide you with access to information about my services which is provided to subscribers only. If I don’t collect your personal data through your subscription, I won’t be able to provide you with this information. 

  • To provide you with my services. If I don’t collect your personal data, I won’t be able to give you access to my services and comply with my associated contractual and legal obligations. 

  • To protect my business and your data from fraud and other illegal activities. 

  • I’ll also monitor your browsing activity on my website, and any use of my service, to quickly identify and resolve any problems and protect the integrity of my website and service. I’ll do this as part of my legitimate interest. 

  • With your consent, I will use your personal data to keep you informed by email, web, text and telephone about relevant products and services. You are free to opt out of hearing from me via these channels at any time. 

When I collect your personal data 

Most of the personal information I process is provided to me directly by you in one of the following circumstances: 

  • When you visit my website I may store information from online analytical tools and the use of cookies (see how I use cookies and similar technologies). 

  • When you enquire about using my services

  • When you use my services 

  • When you choose to complete surveys or respond to information requests 

  • When you contact me by telephone or email or by completing a form on my website

How I use your personal data 

To provide my services, including my website, I hold and process different types of personal data: 

  • Your name, email address and telephone number if you’ve provided me with these

  • Information about your use of my website and services, including the internet protocol (IP) address used by the device(s) you use  

Updating your information 

Please keep me informed if any of the information that I hold about you changes. 

I may also use publicly available sources to ensure that the information I hold is accurate and up to date. 

Sharing your personal data with other organisations 

I will not share your information with third parties for their own purposes unless this is explained to you at the time I collect your information, or I am legally required to do so, or I have another lawful basis for sharing such information. 

I may process personal data where I have a specific legal duty, or where it is necessary to enable me to enforce or apply my terms of use or protect my, or your, legitimate interests, safety or rights. 

I share anonymous information with the online analytics and search engine providers that assist me to improve and optimise the use of my site. 

I do not sell the data that is captured or recorded through the website or the services for commercial benefit. 

If I sell all or part of my business, I may need to share your personal data with the organisation taking on my assets and liabilities. 

Anonymised data: I also collect anonymised information for statistical purposes. Although survey data is collected by reference to individual users (so you’re not asked to participate multiple times in the same surveys), the response data is collated anonymously. Where I use this information, I never identify specific individuals. I may also share anonymised information with individuals or organisations interested in my services.

Transferring your personal data outside the EEA 

Some of my third party service provides may manage information outside the EEA. In these circumstances I will ensure the country or organisation where the data is held has been approved as having adequate data protections standards by the UK and EU. 

How long I hold your personal data 

I will only retain your personal information for as long as necessary to fulfil the purposes I collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

 In respect of client data, you can expect me to hold data relating to your instructions for a period of seven years after completion of the last coaching interaction. I have a legitimate business interest in retaining the data for this length of time should any subsequent legal proceedings ensue.

Given the nature of my services clients often return to me with repeat instructions within weeks, months or years of contacting me in the first instance. The seven-year period referred to above will start from the last contact I had with the client, third party or supplier, to ensure I am able to assist as and when I need to. Should you not contact me for seven years, I will confidentially destroy all data held for you.

In some circumstances I may anonymise your personal information so that it can no longer be associated with you, in which case I may use such information without further notice to you. 

Your rights over your personal data 

The data protection laws include a number of specific rights that you have to ensure that your data is collected and handled in a secure and appropriate manner.   

You have the right to be informed about how I collect and use your personal data, and to request: 

  • Access to the personal data I hold about you, free of charge in most cases 

  • The correction of your personal data when inaccurate, out of date or incomplete 

  • The deletion of data I hold about you, in specific circumstances, eg where you withdraw consent or object and I have no legitimate overriding interest, or once the purpose for which I hold the data has ceased 

  • Restriction of the use of your personal data, in specific circumstances, eg while I are assessing an objection you have made 

  • A copy of your personal data in a commonly used electronic format; 

  • That I stop using your personal data for direct marketing (either through specific channels or all channels) 

  • That I stop any consent-based processing of your personal data after you withdraw that consent.  

You can contact me to request to exercise these rights at any time by emailing yvette@yvettecoldicott.com and I will action your request within one calendar month. If I choose not to action your request, I will explain the reasons for my refusal. 

You will not usually have to pay a fee to access your personal information, or to exercise any of the rights above. However, I may charge a reasonable fee if your request for access is clearly unfounded or excessive. 

I may request specific information from you in order to confirm your identity and ensure your right to access the information. This is a security measure to ensure that personal data is not disclosed to anybody who has no right to receive it. 

If you are not happy with any aspect of how I collect and use your data, you have the right to complain to the Information Commissioner’s Office (ICO), which is the UK supervisory authority for data protection issues. I would be grateful if you would contact me in the first instance if you do have a complaint, so that I can try to resolve it for you. 

How I keep your personal data secure 

I know how much data security matters to all of us, both as individuals and as professionals, and will treat your data with the utmost care, taking all appropriate steps to protect it. 

There is secure access to all transactional areas of my websites and applications using encrypted ‘https’ technology. Access to your personal data is always password-protected.  

I regularly monitor my system for possible vulnerabilities and attacks and stay abreast of best practice.  

Where I provide links to websites of other organisations, this privacy notice does not cover how that organisation processes personal information. I encourage you to read the privacy notices on the other websites you visit.  

Marketing Communications

From time to time I may wish to communicate with you to: 

  • Seek feedback on my services 

  • Inform you of my services that may be of interest to you 

  • I also provide a newsletter to share my blog and other news 

My lawful ground of processing your personal data to send you marketing communications is either your consent or my legitimate interests (namely to grow my business).

Under the Privacy and Electronic Communications Regulations, I may send you marketing communications from me if (i) you made a purchase or asked for information from me about my goods or services or (ii) you agreed to receive marketing communications and in each case you have not opted out of receiving such communications since. Under these regulations, if you are a limited company, I may send you marketing emails without your consent. However, you can still opt out of receiving marketing emails from me at any time.

You can ask me to stop sending messages at any time by following the opt-out links on any marketing message sent to you OR by emailing yvette@yvettecoldicott.com.

If you opt out of receiving marketing communications this opt-out does not apply to personal data provided as a result of other transactions, such as the service that I provide to you.

What are cookies? 

“Cookies” are pieces of information that are stored as tiny text files on your computer's hard drive and which record how you move your way around a website so that, when you revisit that website, it can present tailored options based on the information stored about your last visit. Cookies can also be used to analyse traffic and for advertising and marketing purposes.

How I use cookies

I use cookies to improve your experience on my website and to show you personalised content. For example, they help me tell how often you use my services, pages you visit, when you visit, how long you stay connected on my site or services and what kind of device you use to do so. This information helps me to develop and improve my website as well as refine my products and/or services in response to what you might want or need.

By using this website, Squarespace uses certain cookies to store and process user data. Squarespace uses this information to evaluate the use of the website and to compile reports ("Statistics") about the website activity for me. By using this website, you agree to the processing of the data collected about you by Squarespace Inc. in the manner described in the Squarespace Privacy Policy.

What happens if you disable cookies? 

If you want to check or change what types of cookies you accept, this can usually be altered within your browser settings. You can block cookies at any time by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) your experience of using my website may be more limited, as some of the cookies help me to display relevant content.

I may update this policy to reflect changes in how I use your information. You may wish to check this policy each time you provide me with your information. Where appropriate, I will provide you with notice of any significant changes to how I use your information.
